Terms of Service

These Terms of Service (these "Terms") set forth the conditions for the provision of Memotto (the "Service") and govern the rights and obligations between the operator and users of the Service ("Users"). By using the Service, you agree to be bound by these Terms.

Article 1 (Application)

These Terms apply to all matters relating to the provision and use of the Service. Any guidelines posted on the Service from time to time by the operator shall form part of these Terms.

Article 2 (User Registration)

As a general rule, the Service does not require user registration. Conditions for any registration features offered in the future will be separately specified.

Article 3 (Prohibited Acts)

When using the Service, Users shall not engage in any of the following acts.

• Posting or publishing content that violates laws, regulations, or public order and morals
• Publishing content that infringes the copyrights, trademarks, patents, or other intellectual property rights of third parties
• Publishing content that infringes the honor or privacy of third parties (including defamation and unauthorized posting of personal information)
• Posting personal information (name, address, phone number, email address, etc.) of third parties in places visible to others, such as public memos or comments
• Publishing content related to obscenity, child pornography, or child abuse
• Publishing content for the purpose of fraud, phishing, malware distribution, or other illicit activities
• Acts that place an excessive burden on servers, or unauthorized access
• Any other act deemed inappropriate by the operator

Notice regarding personal information:When recording personal information in memos, please avoid public settings and we strongly recommend using the password protection feature. Public memos may be indexed by search engines and may become visible to an unspecified number of viewers.

Article 4 (Handling of Content)

Copyright in memos created by Users belongs to the User. The operator may store, back up, and analyze such content solely for the purposes of providing the Service, improving quality, and preventing misuse. When a User makes a memo public, the User grants the operator the right to display and distribute such content on the Service.

Article 5 (Reporting and Removal of Illegal or Infringing Content)

The Service responds as follows in accordance with the Act on the Limitation of Liability for Damages of Specified Telecommunications Service Providers and the Right to Demand Disclosure of Identification Information of the Senders (the "Provider Liability Limitation Act").

• If you discover illegal or rights-infringing content, please contact us via the contact form under the "Removal / Rights Infringement Report" category
• Upon receiving a report, the operator will review the content and respond promptly (typically within 3 business days)
• To verify the authenticity of a report, the operator may request additional information from the reporter
• The operator may remove content that violates Article 3 without prior notice
• The operator may unpublish public memos for reasons of personal information protection or other privacy concerns. When a memo is unpublished, a notice will be displayed on its edit page

Article 6 (Recording of Sender Information)

For the purpose of responding to disclosure requests for sender information under the Provider Liability Limitation Act, the operator records the IP address, user agent, and timestamp of Users who perform memo publishing actions. This information will not be disclosed to third parties except in response to a court order or other lawful request under applicable law. For details, please refer to the Privacy Policy.

Article 7 (Changes and Suspension of the Service)

The operator may change or suspend all or part of the Service without prior notice to Users.

Article 8 (Disclaimer)

The operator shall not be liable for any damages arising from natural disasters, communication failures, illicit acts of third parties, or other causes not attributable to the operator. The same shall apply to indirect damages or lost profits arising from use of the Service. The operator also makes no warranty as to the content or accuracy of any content published by Users.

Article 9 (Governing Law and Jurisdiction)

These Terms shall be governed by the laws of Japan. In the event of a dispute relating to the Service, the court having jurisdiction over the location of the operator shall be the exclusive court of first instance by agreement.
